Terms of Service

Welcome to Truckr. These Terms of Service ("Terms") govern your access to and use of the Truckr mobile application and the truckr.com website (collectively, the "Service") operated by Wright Media LLC ("Company," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. Some features (such as age- restricted content or CDL-specific features) may require you to be 18 or 21 years or older. By using the Service, you represent that you meet these age requirements and that you have the authority to enter into these Terms.

2. Account Creation and Security

• You must provide accurate information when creating an account, including a valid phone number.
• You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You may not create an account on behalf of another person without permission.

3. User-Generated Content

The Service allows you to post content, including text, images, GIFs, and messages ("Content"). You retain ownership of your Content, but by submitting Content you grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, adapt, and distribute your Content in connection with operating and promoting the Service.

3.1 Your Responsibility

You are solely responsible for the Content you post. You represent that you have all necessary rights to post your Content and that your Content does not violate any law or these Terms.

4. Prohibited Conduct and Zero Tolerance for Objectionable Content

Truckr has zero tolerance for objectionable content or abusive behavior. You agree not to post, upload, share, or transmit any Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
• Depicts or promotes violence, hate speech, self-harm, sexual exploitation, or child sexual abuse material.
• Contains pornography, nudity, or sexually explicit material.
• Infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights.
• Constitutes spam, pyramid schemes, or unsolicited advertising.
• Contains viruses, malware, or any other harmful code.
• Impersonates any person or entity.
• Contains misinformation that could cause harm (e.g., fraudulent job postings).

You also agree not to:

• Harass, bully, intimidate, or threaten other users.
• Attempt to gain unauthorized access to the Service or other users' accounts.
• Scrape, crawl, or use automated means to access the Service.
• Interfere with or disrupt the Service or servers.

5. Reporting and Moderation

We reserve the right, but not the obligation, to monitor, review, or remove Content at our discretion. We use automated tools (including AWS Rekognition) to scan images for prohibited content before upload.

Users may report Content they find objectionable directly from the app using the flag icon on any post or reply. Reports are reviewed by our moderation team, and we will act on clearly violating content within 24 hours.

6. Blocking Other Users

You may block any other user from within the app. Blocking a user will:

• Immediately remove their posts and replies from your feed.
• Prevent the blocked user from sending you direct messages or seeing your content.
• Hide the blocked user from search results and notifications.

7. Enforcement

We may suspend, remove, or terminate accounts that violate these Terms without prior notice. Violations include posting prohibited Content, abusive behavior, or repeatedly receiving substantiated user reports.

8. Account Deletion

You may delete your account at any time from within the app (Profile → Delete Account). Upon deletion, your profile will be removed from public view and your ability to sign in will be disabled. See our Privacy Policy for details on data retention after deletion.

9. Intellectual Property

The Service, including all software, graphics, logos, and text (other than User Content), is owned by Wright Media LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works from the Service without written permission.

10. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. Job postings, route tips, and other User Content are not verified by us — use your own judgment.

11. Limitation of Liability

To the maximum extent permitted by law, Wright Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Wright Media LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the Service, your Content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which Wright Media LLC is incorporated, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in that jurisdiction.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through in-app notification. Your continued use of the Service after changes become effective means you accept the updated Terms.
